Terms of Use

These Terms of Use were last updated on January 6, 2004

Thank you for visiting Citizen-Journal.net (hereinafter referred to as “we” or the “Site” or “Citizen-Journal”).   By accessing the Site in any way, you agree to comply with these Terms of Use (“Terms”).

I. AGREEMENT TO TERMS AND UPDATES

The Terms may be updated periodically and without prior notification.  Anyone who accesses the Site should be sure to check this section of the Site periodically for changes to these Terms, because we will provide notice of significant changes to the Terms by posting updated Terms here.  Your use of the Site constitutes your agreement with the Terms as most recently updated.  You can always review the current version of the Terms at: http://www.citizen-journal.net/Terms-of-Use.  

II.  CONTENT

The content on the Site constitutes a free service that is provided for the benefit of our users.  Citizen-journal.net provides its users with access to others' viewpoints, perspectives, and opinions and a forum in which these may be discussed online (hereinafter “Content”). As such, the Content displayed on the Site is an assortment of fact, opinion, viewpoints, and ideas, and a collection of links to online resources.  In accessing the Site, you may encounter:

    Messages posted by other users of the Site, contributions, letters, articles, events, including but not limited to data, text, files, images, sounds, hyperlinks, or other materials that are posted on, transmitted through, or linked from the Site.

    Hyperlinks to websites provided by parties that are completely independent of and unrelated to the Site and its owners.  

We do not control the Content posted on Site, and we do not guarantee the accuracy, integrity, or quality of Content.  Under no circumstances will we be liable in any manner for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Site.  Such Content is the sole responsibility of those with whom the Content originates, and by using the Site, you agree to hold Citizen-Journal and its owners harmless for any Content on the Site, irrespective of where it originates.  

In addition to the above, you agree that by accessing the Site, you are solely responsible for the content of your own postings, emails, discussions, and messages, and that you are using these services on the Site at your own risk.

III. PRIVACY

It is our policy to protect the privacy of visitors to the Site. We have established a Privacy Policy to explain to users how their information is collected and used, which is located at http://www.citizen-journal.net/Privacy-Policy.htm. Please read the Privacy Policy link so that you will understand how we gather and use certain information about you.

IV. NO SPAM

Any unauthorized use of the Site is a violation of these Terms and certain federal and state laws, including without limitation the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.).  Such violations may subject the sender and his or her agents to civil and criminal penalties.  We reserve the right to seek civil redress against anyone who violates our “no spam” policy.

V. LIMITATIONS

You agree that the Site may establish certain limits concerning use of the Site, including but not limited to restrictions on the volume or frequency of Content.  We have no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Site.  We reserve the right at any time to modify or discontinue the Site (or any part thereof) with or without notice.

You agree to certain limitations on your access as a User of the Site. We have the right to delete or terminate your user account, block your email or IP address, or otherwise terminate your access to or use of the Site (or any part thereof), immediately and without notice, and remove and discard any Content within the Site, for any reason, including, without limitation, if we believe that you have acted inconsistently with the letter or spirit of the Terms.  We retain the right, but no obligation, to refuse, delete or move any content that is available via the Site, for violating the letter or spirit of the these Terms or for any other reason.

VI.  INTELLECTUAL PROPERTY

You agree that the Site and the Content are protected to the maximum extent permitted by copyright laws and international treaties. Content displayed on or through the Site is protected by copyright as, without limitation, a collective work and/or compilation pursuant to copyright laws and international conventions.  Further, authors of Citizen Journal articles retain exclusive rights to their work, and individual articles published in the Citizen Journal are protected to the fullest extent permissible under federal and state copyright laws and local law. You are prohibited from creating or contributing to the creation of any reproduction, modification, or creation of derivative works from or redistribution of the Content, the Site or the collective work.  

VII. NO WARRANTIES

By using the Site, you agree that you are using the Site at your own risk and that all content on the Site or made available by or accessible through the Site is provided “as is,” without any express or implied warranties of any kind, including but not limited to the accuracy, completeness, timeliness, non-infringement, title, merchantability, or fitness for a particular purpose.  We shall not be liable to you or to anyone else for any damages or injuries caused, directly or indirectly, from the use of the Site, or by contingencies beyond its control in collecting and posting content on the Site.  Because some states do not permit the exclusion of all types of warranties, not all of the above limitations will necessarily apply to each person accessing the site.

You agree that if you download or otherwise obtain Content through the Site, you do so at your own risk. You are solely responsible for any damage to your computer system or loss of data that results from the download of any material.

VIII. LIMITATIONS OF LIABILITY

YOU AGREE THAT UNDER NO CIRCUMSTANCES SHALL CITIZEN-JOURNAL BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF CITIZEN-JOURNAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF CITIZEN-JOURNAL HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES) THAT RESULT FROM ANY ASPECT OF YOUR USE OF THE SITE OR THE SERVICE, FROM: (1) THE USE OR INABILITY TO USE THE SITE, INCLUDING THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE SITE; (2) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT; (3)  STATEMENTS OR CONDUCT OF ANY THIRD-PARTY RELATING TO THE SITE; OR (4) ANY OTHER MATERIAL RELATED TO THE SITE.  SUCH LIMITATIONS SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE SITE OR ANY LINKS ON THE SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE SITE OR ANY LINKS ON THE SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify and hold Citizen-Journal, its officers, subsidiaries, affiliates, successors, assigns, agents, service providers, suppliers and employees harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third-party due to or arising out of Content you submit, post or make available through the Site, your use of the Site, your violation of the Terms, your breach of any of the representations and warranties herein, or your violation of any rights of another.  

In some jurisdiction, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitations may not apply to you.  

IX. VIOLATIONS OF TERMS OF USE

X. GENERAL

The Terms constitute the entire agreement between you and Citizen-Journal and govern your use of the Service, superceding any prior agreements between you and Citizen-Journal. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. You agree that any failure of Citizen Journal to exercise or enforce any right or provision of the Terms shall not be considered a waiver of any such right or provision.
